How to Change Your Status to M-1 for Flight Training

Student preparing M-1 flight training documents
Changing to M-1 status for flight training from inside the U.S.: who qualifies, the I-20 and I-539 steps, what to avoid while pending, and what happens if you travel.

You can change to M-1 status without leaving the United States, but only if you are in valid nonimmigrant status, have been accepted by an SEVP-certified flight school, and file Form I-539 with USCIS before you start training. Flight training under M-1 must be vocational and delivered by a school certified under FAA Part 141 or Part 142. The sequence matters more than any single form: school acceptance, I-20, SEVIS fee, I-539, approval, and only then your first lesson.

This guide walks through each step in order, flags the mistakes that cost applicants their status, and explains what a change of status does and does not give you.

  • You are eligible only if you were lawfully admitted, hold valid current status, and have not violated its conditions.
  • The school comes first: an SEVP-certified school must accept you and issue an initial Form I-20 marked as a change of status.
  • Pay the I-901 SEVIS fee and file Form I-539 with USCIS. Do not begin vocational flight training until USCIS approves, especially from B-1 or B-2 status.
  • Approval lets you stay in the U.S. as an M-1 student. It is not an M-1 visa, so travel abroad usually means applying for the visa at a U.S. embassy or consulate.
  • M-1 cannot later be converted to F-1 inside the U.S., so choose the right category now.

Who can change to M-1 status

USCIS sets four basic conditions for any change to a nonimmigrant F or M student status. You must have been lawfully admitted, hold valid current nonimmigrant status, not have violated its conditions, and have no disqualifying criminal history or other ineligibility factors. A visitor on a B-2 stay, a tourist whose I-94 is still current, or a person in another qualifying status can all be candidates, provided nothing in their record breaks those conditions.

The point that catches the most applicants is a prior violation. USCIS states that individuals who have violated their status by enrolling in a course of study are not eligible to change to F-1 or M-1. If you have already taken classes on a visitor status, an in-country change is not available, and your realistic path is to leave, obtain the visa abroad and re-enter as an M-1 student.

Why M-1 and not F-1 for pilot training

The two student categories split by program type. M-1 students pursue vocational or other nonacademic programs, other than language training, while F-1 covers academic and language programs. Professional pilot training at a flight school is vocational, which is why most international flight students enter under M-1. If you are weighing the two, our comparison of ਉਡਾਣ ਦੇ ਵਿਦਿਆਰਥੀਆਂ ਲਈ M-1 ਬਨਾਮ F-1 covers the work-authorization differences in detail.

Which schools qualify

Not every flight school can enroll you. SEVP-certified flight training providers must hold FAA Part 141 or Part 142 certification, and SEVP does not approve providers to enroll nonimmigrant students in Part 61 programs. A school that tells you a Part 61 course will support an M-1 I-20 is describing something the program rules do not allow. Before you pay a deposit, ask for the school’s SEVP certification and its Part 141 certificate. If you want the background on what the certification means, see what FAA Part 141 is.

ਕਦਮ-ਦਰ-ਕਦਮ ਪ੍ਰਕਿਰਿਆ

The order below follows the USCIS and Study in the States guidance. Reversing it is the most common way applications fail.

  1. Choose a Part 141 or Part 142 school and apply. You must apply to and be accepted by an SEVP-certified school.
  2. Receive an initial Form I-20 marked for change of status. The school issues it with the change of status indicated in the Issue Reason section, as USCIS describes.
  3. I-901 SEVIS ਫੀਸ ਦਾ ਭੁਗਤਾਨ ਕਰੋ। Keep the receipt; it goes into your filing.
  4. File Form I-539, Application to Change Nonimmigrant Status, with USCIS. Attach the I-20, the fee receipt, proof of your current status and your financial evidence.
  5. Wait for the decision while maintaining your current status. Do not start vocational training in the meantime.
  6. Begin training only after approval, and with the start date your I-20 shows.

Preparing the I-20 and financial proof

The I-20 is only as strong as the financial evidence behind it. The school needs to see that you can cover tuition, fees and living costs for the program, and the figures on the form must match your supporting documents. Our guide to the five costs your I-20 must show lists what a DSO will want to see before issuing the document. Allow time for this: a school cannot issue an I-20 on an incomplete file, and our note on securing your I-20 60 days before start explains why early preparation matters.

For fees, always read the current amounts on the official forms pages rather than relying on a figure copied from an older article. The I-539 fee is set in the USCIS Fee Schedule, and the SEVIS fee is published on the SEVP site. Fees change, and an application filed with the wrong amount is rejected.

Timing against your program start date

The rule on timing is specific. M-1 applicants must maintain valid nonimmigrant status while Form I-539 is pending. If their status expires more than 30 days before the program start date, they must obtain status through the date 30 days before that start date. In practice, that means a short visitor stay may need an extension filed first. Do not plan on a start date that sits months beyond your authorized stay and hope the pending application covers the gap.

Can you stay and train while the application is pending?

You can generally remain in the United States while the case is pending, as long as your current status has not been violated. Training is the problem. If your current status does not permit study, do not begin vocational flight training while your application is pending. Study in the States is explicit that people in B-1 or B-2 status should not begin vocational studies or enroll in classes until USCIS approves the change.

This is where an eager student does the most damage. A discovery flight is one thing; logging dual instruction toward a certificate on a visitor status is another, and it can turn a clean application into an ineligible one. Wait for the approval notice, then start. If your school offers a later start date, take it.

ਇਹ ਕਿੰਨਾ ਸਮਾਂ ਲਗਦਾ ਹੈ?

Processing times vary by service center and caseload, and USCIS publishes the current figures on its processing times page, so check it for the form and category you are filing. USCIS also offers premium processing for this category: applicants who request it receive adjudicative action within 30 business days after all prerequisites are met. The premium fee is listed in the USCIS Fee Schedule. Premium processing speeds up the decision, not the quality of the filing, so a complete package still matters more than speed.

What approval gives you, and what it does not

Approval of a change of status lets you remain in the U.S. as an M-1 student. It does not give you a visa. According to the State Department’s Foreign Affairs Manual, a change of status approval only allows you to remain in the country in that status, and if you leave you will generally need an M-1 visa from a U.S. embassy or consulate abroad before re-entering as an M-1 student.

That has a planning consequence. If your training will include a trip home, build in the time for a visa appointment, and carry your I-20 with an up-to-date DSO signature. Our guide to M-1 visa requirements for flight training ਅਤੇ application-to-takeoff walkthrough cover the consular side.

Living with M-1 status once approved

Duration and extensions

M-1 is not open-ended. Status lasts for the time necessary to complete the course of study, plus authorized practical training and 30 days to depart, not exceeding one year. Extensions are possible but capped: cumulative extensions, including practical training, are limited to three years from the original start date, plus 30 days. An extension application goes on Form I-539, filed 15 to 60 days before the program end date on your I-20.

M-1 duration and extension filing timeline

The practical lesson for pilot students is to choose a program with a realistic, well-structured timeline. Accelerated Part 141 programs with a defined syllabus make it easier to stay within your I-20 dates than open-ended hourly training.

Full course of study

M-1 students must pursue a full course of study unless a DSO authorizes a reduced load for medical reasons. A string of cancelled lessons, long gaps for weather or aircraft availability that you could have avoided, or part-time scheduling can put your status at risk. Ask a school how it schedules aircraft and instructors, and whether it has its own checkride authority to avoid idle weeks waiting for an examiner.

ਟ੍ਰਾਂਸਫਰ

Transfers are tightly limited. A transfer is allowed less than six months into the program if the student cannot remain at the current school due to circumstances beyond their control, and USCIS must authorize it. Because of this, the first choice of school is the one that counts. Compare the program, aircraft, schedule and checkride process before you file, not after.

Work and practical training

M-1 students are not eligible for employment during the program. After completing the vocational course, they may obtain authorization for practical training with a DSO recommendation and USCIS authorization. Our overview of whether M-1 students can work goes through how that plays out for pilots.

If you are not eligible, or your application is denied

There is a clean fallback, and it is worth knowing before you file. If USCIS denies the application, be prepared to leave the U.S. when your current status expires. If you are not eligible to change status here, you may leave, apply for a visa if applicable, and re-enter as an M-1 student.

Two conversions are closed once you hold M-1. According to USCIS guidance in Spanish, M-1 students cannot change to F status in the U.S., nor to H status if the M-1 training supplied the qualifications for the temporary worker role. If your long-term plan involves an employer sponsoring you, speak to an immigration attorney before choosing the category, because a change that looks convenient now can limit you later.

Where an in-country change is risky, applying for the M-1 visa from abroad is often the more predictable route. It costs a flight and an appointment but removes the uncertainty of a pending petition and the restriction on starting training.

Choosing the right school before you file

The change of status depends on your school’s certification, its I-20 quality and its ability to keep you on schedule. When you compare schools, check these points:

  • SEVP certification and FAA Part 141 or Part 142 approval, in writing.
  • A published program structure with a start and end date that fits within your I-20.
  • Pricing that is transparent, so the I-20 financial figures are accurate.
  • How checkrides are scheduled, since long waits for an outside examiner extend your timeline.
  • Experience with international students and SEVIS reporting.

If you are planning a path from private pilot through to the airlines, our Part 141 commercial requirements guide shows how the training stages fit together.

ਸਾਡਾ ਦ੍ਰਿਸ਼ਟੀਕੋਣ

Most students who contact us about changing status are not short of ambition. They are short of sequence. They find a school, book a flight lesson, and only afterward learn that the lesson was the one thing they could not do.

We build our approach around that discipline. Florida Flyers Flight Academy trains under FAA Part 141 and supports international students with M-1 enrollment, and we hold Self Examining Authority, which means we can conduct FAA checkrides in-house instead of leaving a student’s I-20 clock running while an outside examiner is found. For a student on M-1, where the program end date is a real boundary, that is career velocity you can plan around.

Our advice is simple. Settle the school first, get an I-20 that states the full cost honestly, file once with complete evidence, and wait for approval before you fly. A fixed-price model removes the other source of risk, the ticking of a Hobbs meter that runs past a quoted budget and forces a mid-program financial scramble.

ਸਵਾਲ

Can I change from a tourist visa to M-1 without leaving the U.S.?

Possibly, if you were lawfully admitted, your status is still valid, and you have not violated it, for example by studying. You need an I-20 from an SEVP-certified school and an approved Form I-539. Do not begin training until USCIS approves.

Does changing status give me an M-1 visa?

No. Approval only lets you remain in the U.S. as an M-1 student. If you leave, you will generally need to obtain an M-1 visa at a U.S. embassy or consulate before re-entering in that status.

Can I start flight lessons while my application is pending?

Not if your current status does not allow study. B-1 and B-2 visitors in particular should not start vocational classes until USCIS approves the change. Starting early can jeopardize the application.

How long can I stay in M-1 status?

Status covers the time needed to finish the course, plus authorized practical training and 30 days to depart, up to one year at a time. Total extensions are capped at three years from the original start date, plus 30 days.

Can I switch from M-1 to F-1 later?

Not while in the United States. M-1 students cannot change to F status here, so confirm that M-1 is the right category for your program before filing.
